When using our services, it is necessary that you reveal personal data in order to establish your identity which will allow you to make fund transactions.  Such data includes personal data that is collected from the account opening form, from identification documents needed to support an account opening application, and personal financial data, etc.  The company will process personal data to verify your identity, using documents and/or photographs and/or electronic media.

2.1 Basis of Contract

When you open a fund account to deal with fund investments, or use the services, or conduct tasks related to various fund services, you will need to submit personal data to the company. The company needs to use such data to open a fund account, set up processes to support your fund investment activities, including using your data to compute entitlements and benefits related to your investment in the fund products. We also need such data to contact and communicate with you, keep you updated about benefits and changes to your fund products and services, reply to your queries, notify you about any changes, etc.

 
2.2 Basis for Consent

The company may use your personal data in data processing tasks that help us further design or develop products and services to be offered for marketing purposes. This also includes collection, usage, and disclosure of your personal data for direct marketing activities if consent is given.

 If you wish to provide consent, or withdraw consent, regarding the handling of your personal data as mentioned above, you may contact the company and express your intention. See clause 9 for details.
 

2.3 Basis for Legitimate Interest

The company may use your personal data in data processing tasks necessary for administrative and internal reporting purposes, for system controls and maintenance of service standards, including tax processing and risk management.
 

2.4 Basis for Legal Obligation

The company may use your personal data in data processing tasks needed to comply with the regulations applicable to the company’s business operations. Note that the company will not process any type of sensitive data.


The handling of sensitive personal data requires prior consent from the client or investor, or the discretion of the Data Protection Officer. The Data Protection Officer’s judgement is considered final.

 

The company may reveal your personal data to our parent company and/or affiliate companies and/or external parties who needs to access such data in order to fulfill tasks that require such personal data. The company may disclose and send your personal data to the following parties :
 

• Krungthai Bank (parent company), affiliate companies such as KTB General Services and Security Company Limited (KTBGS), KTB Computer Services Company Limited (KTBCS), KTB Law Company Limited (KTBLAW), Infinitas By Krungthai Company Limited, Arise By Infinitas Company Limited, Krungthai XSpring Securities Company Limited (KTX), KTB Advisory Company Limited (KTBA), Krungthai Mizuho Leasing Company Limited, Krungthai Card Company Limited (KTC), KTB Leasing Company Limited (KTBL), KTC Nano Company Limited, KTC Pico (Bangkok) Company Limited, KTC Pico (Chonburi) Company Limited, KTC Pico (Pathum Thani) Company Limited, KTC Pico (Samut Prakarn) Company Limited, KTC Pico (Samut Sakorn) Company Limited, KTC Prepaid Company Limited, Krungthai Panich Insurance Company Limited, Krungthai AXA Life Assurance Company Limited.
   
• Agents, representatives, custodians/trustees, intermediaries, and/or other service providers which you (and/or other members of your investor group) or the company had appointed.
   
• Agents, vendors, and service providers who are external parties. This will enable such person and/or juristic person to provide services to KTAM or yourself, such as affiliate companies, selling agents, distributors, financial institutions, business partners, professionals, experts and various other service providers, i.e. IT and communications companies, insurance companies, travel/event coordinators for conferences, meeting organizers, Thailand Securities Depository Company Limited, credit card companies, and/or foreign asset management companies that KTAM feeder funds invest in, and other external parties which KTAM collaborates with when offering our products and services.
   
• If you have a joint account or belong to a group of investors under one account, the company may disclose your personal data to other members in your joint account or in your group account.
   
• Counterparties, securities brokers, Stock Exchange of Thailand, Thailand Securities Depository, and other parties, may see your personal data as necessary to allow such parties to perform tasks needed to accomplish your objectives in using the services of KTAM.
   
• Regulators, state authorities, or supervisory bodies such as the Securities and Exchange Commission, Office of the Auditor General, Legal Execution Department (Ministry of Justice), Royal Thai Police, and any other parties whom KTAM is obligated to disclose your personal data to comply with relevant laws and regulations, or for specific circumstances such as a court order.
   
• Contract partners or foreign funds. Your personal data may be revealed when requested in order to comply with the law.
   
• Potential investors in the company or its representative who is conducting a due diligence, regardless of whether acquiring a shareholding, or making a full/partial purchase of the business operations or assets

Only after receiving explicit consent from you, the company may use your personal data in automated data processing tasks that affect your data or to collect other data for purposes such as marketing. If you wish to withdraw consent for the handling of your personal data, you may contact the company as detailed in clause 9.

When the company collects, uses, or discloses (process) your personal data through methods mentioned in this document, you have these rights :
 

• Right to be informed about how your personal data is processed, how your personal data is collected, parties who can see your personal data, including reason and time period the data is maintained.
• Right to access or to receive a copy of your personal data collected by the company, either directly or indirectly.
• Right to amend your personal data to correct any errors.
• Right to request that your personal data be erased, destroyed, temporarily suspended from use, or anonymize the data.
• Right to removal of consent previously granted to the company to use your personal data.
• Right to limit usage of your personal data.
• Right to object to the use of your personal data.
• Right to file a complaint with the Office of the Personal Data Protection Commission if you believe the company has breached your rights.

To make such aforementioned request as entitled by law, please notify us in writing. KTAM will use every effort to complete the requested tasks within a suitable time frame and by the deadline required by law.  We comply with the regulations regarding your rights under the Personal Data Protection Act.

Restrictions imposed on the company’s ability to handle tasks and provide services, in cases where you have requested the company to erase, destroy, limit usage, temporarily suspend usage, anonymize, or withdraw consent, may inhibit the company’s ability to handle tasks and provide services to you. As such, you will not be entitled to file complaints for any damage or loss from the company under those circumstances, unless the collection, use, disclosure, and transfer of personal data is unlawful or breaches the contract made with the client or investor.

When exercising your aforementioned rights, the company reserves the rights to charge a service fee relevant and necessary to perform the task concerning your personal data as requested.
 

According to the basis that your personal data will maintained only as necessary, the company will maintain your personal data in its possession for the time period necessary to perform the tasks for which the personal data was required, as stated by law :
 

• Basis for Legal Obligation, which prescribes a time period of 10 years after you have opened a fund account.
• Once the data maintenance period has expired, the company will delete or anonymize the personal data.

The company protects your data through measures deploying documents (Hard Copy), electronic methods, and techniques to prevent access to your personal data by unauthorized parties. The company establishes controls and mechanisms to detect and recall data whenever an unintended event occurs.

The Privacy Notice may be revised and amended from time to time, without prior notice. Whenever the Privacy Notice is updated, the latest version will be available on the company website www.ktam.co.th
